1. Definitions

In these Terms and Conditions:

• "Kinvale", "we", "us", or "our" refers to Kinvale, a business operating from 12, Jalan Kia Peng, 50450 Kuala Lumpur, Malaysia.
• "Session" refers to any educational workshop, planning session, or programme offered by Kinvale.
• "User" or "you" refers to any individual accessing our website or engaging with our sessions.
• "Agreement" refers to these Terms and Conditions together with any session booking confirmation.
• "Content" refers to all written materials, guides, templates, and resources provided by Kinvale.

2. Acceptance of Terms

By accessing our website or booking a session, you confirm that you have read and agree to these Terms and Conditions. You must be at least 18 years of age to book or attend a session. By submitting an enquiry or booking form, you confirm that you have the capacity to enter into this agreement.

3. Nature of Services

Kinvale provides educational workshops and document-organisation sessions. All sessions are strictly educational in nature. Kinvale does not provide legal, financial, medical, therapeutic, or counselling services of any kind. Nothing said or provided by Kinvale during sessions or through our website constitutes professional advice. Participants are encouraged to consult qualified professionals for decisions relating to legal, financial, or personal matters.

4. Session Booking and Attendance

• Sessions are booked by submitting an enquiry through our contact form or by contacting us directly. Bookings are confirmed in writing by Kinvale.
• Sessions are intended for family groups. All participants must be aged 18 or above or must be accompanied by an adult who has agreed to these terms on their behalf.
• Kinvale reserves the right to decline a booking where a session would not be appropriate given the circumstances described.
• If you need to reschedule, please notify us at least 48 hours in advance. We will make reasonable efforts to accommodate rescheduling requests.

5. User Responsibilities

• Participants agree to engage with sessions in good faith and to treat other participants and facilitators with respect.
• Participants agree not to record sessions (audio or video) without prior written consent from Kinvale and all other participants.
• Participants agree not to share other participants' personal information or statements outside the session.
• You must not use our website or services for any unlawful purpose.

6. Intellectual Property

All written materials, guides, templates, and frameworks provided by Kinvale are the property of Kinvale. A limited, non-exclusive licence is granted to session participants to use these materials for personal and family coordination purposes only. You may not reproduce, distribute, or publish these materials without our written consent.

7. Payment Terms

• Session fees are as published on our website and confirmed at the time of booking. All prices are in Malaysian Ringgit (RM) and are inclusive of any applicable taxes.
• Payment is due in full before the session date unless otherwise agreed in writing.
• Accepted payment methods will be confirmed at the time of booking.
• Cancellations made more than 5 working days before a session will receive a full refund. Cancellations within 5 working days are not eligible for a refund unless Kinvale cancels the session or a reasonable alternative date cannot be agreed.

8. Disclaimers

Sessions and materials are provided for general educational purposes only. Kinvale makes no representations about the suitability of session content for any particular family's situation. Outcomes from sessions depend on the participants' own choices and actions, which remain entirely theirs. Kinvale does not warrant any specific outcome from attending a session.

9. Limitation of Liability

To the fullest extent permitted by Malaysian law, Kinvale's total liability to you in connection with any session or use of our website shall not exceed the amount paid for the session in question. Kinvale shall not be liable for indirect, consequential, or special damages, including loss of opportunity or reliance on session content as professional advice.

10. Indemnification

You agree to indemnify Kinvale against any claim, loss, or expense arising from your breach of these terms, your misrepresentation of information, or your misuse of session materials.

11. Termination

Kinvale may cancel a session or decline further bookings if a participant's conduct is disrespectful, the session is being misused, or attendance would create risk to other participants or facilitators. In such cases, fees will be refunded on a pro-rata basis. You may withdraw from a session at any time, subject to the cancellation terms in section 7.

12. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising under these terms shall first be addressed through direct, good-faith communication with Kinvale. Where this does not resolve the matter, disputes shall be subject to the jurisdiction of the courts of Malaysia, with Kuala Lumpur as the agreed venue.

13. General Provisions

• These Terms and Conditions constitute the entire agreement between you and Kinvale with respect to your use of our services.
• If any provision of these terms is found to be unenforceable, the remaining provisions continue in full effect.
• Our failure to enforce any provision does not constitute a waiver of our right to do so in the future.
• These terms may not be assigned by you without our prior written consent.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on our website with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
